General provisions
Joy, gluten free (“Seller”) webshop offers its customers the opportunity to purchase the products from its online store online. These General Terms and Conditions (“Terms and Conditions”) apply to every order placed by a visitor to this e-commerce webshop (“Customer”). Additional terms and conditions of the Client are excluded, unless they have been expressly accepted in advance, in writing.
Offer
Despite the fact that the online catalogue and the e-commerce webshop are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding. Under no circumstances shall the seller be liable in the event of manifest material errors, typographical or printing errors. If the Customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we ask the Customer to contact our customer service in advance.
The offer is always valid while stocks last and can be adjusted or withdrawn at any time. The seller cannot be held liable for the unavailability of a product.
Price
All prices quoted are expressed in euros and, unless otherwise stated, include VAT. If delivery, reservation or administrative costs are charged, this will be stated separately.
The price statement refers exclusively to the articles as they are described verbatim. The accompanying photos are intended to be decorative and may contain elements that are not included in the price.
Online payment
The Customer has the choice between bank, credit card transfer and Paypal as payment methods.
The Seller is entitled to refuse an order due to a serious breach on the part of the Customer in relation to orders involving the Customer.
Order and delivery
Orders cannot be cancelled once production is made.
The Customer must make sure his order has a delivery fee paid, when ordered for delivery or your order maybe put on hold or cancelled. Delivery orders will not be dispatched without delivery fees.
The Seller may occasionally change the delivery dates in the following events
- Where items are out of stock
- Issues with orders (wrong item ordered)
- Order date mistakes (you agree we can deliver a day or two early or a day or two late if we need to)
Pick up is possible at Rue Philippe Le Bon, 1000 Bruxelles, only based on confirmed appointment, on:
- Friday 6-8 pm
- Saturday 9.30-12.30 am
- Sunday 9.30-12
Deliveries are possible in Brussels and +/- 10 km, only based on confirmed appointment:
- Saturday 9.30-12.30
- Sunday 9.30-12
The price for the deliveries in Brussels and +/- 10 km is based on distance
Some products can be shipped via post across Belgium, Germany, Netherlands and France; please check on specific product pages.
When selecting this option, the Seller cannot guarantee exact delivery dates or delivery times, but the Customer will receive a delivery notice from the selected post operator, with the expected day and hours window.
Causes of delay include mis-sorts by the courier company, traffic accidents and driver errors.
Unfortunately, these cannot be eliminated so by placing an order; the Customer agrees to accept the delivery a day late.
The order is packed in protective packaging and has an indicated shelf life ambient when it is dispatched. If the order is delivered one day late, the Customer should follow our storage document instructions
Replacement
The Seller will replace the Customer order if any issue arises with the product due to delivery (damage) or if it takes more than three days in transit.
If the order arrives one day after it was supposed to arrive it is not eligible for replacement.
No refunds are possible if products have shipped, the Seller can only replace them; photos and an email that shows the issue clearly are required.
The Seller does not replace or refund parcels that have been delivered with proof of delivery to the correct address (regardless of the circumstances). The delivery operator will send to the Customer a delivery window before delivery and let the Customer know when the parcel has been delivered. The Customer must actively manage this to ensure to get his parcel.
If the Customer does not get his correctly delivered parcel with proof of delivery, he/she must take this up with the building management or local police. The parcel would not be eligible for a replacement.
Data Entry
The Customer shall ensure to have entered the correct information on the order, incorrect information may incur processing delays.
When provide wrong information the order maybe delayed or cancelled.
Commercial Policy
The Seller reserves the right to change the price, type, product, size, and composition of any of our products without notice.
Commercial Exclusivity
The Seller products are exclusively made for direct consumers and it is illegal to sell these products or reuse them for any commercial purposes without our explicit consent.
The Customer must have explicit permission in writing from the Seller to reuse our products for commercial purposes.
Any evidence of retail usage will be liable to compensation request for the Seller, to be handles by the court of the Seller’s domicile
Impairment of validity – non-renunciation
If any provision of these Terms and Conditions is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.
The failure of the Seller at any time to enforce any of the rights enumerated in these Terms, or to exercise any right thereof, shall never be deemed to be a waiver of such provision and shall never affect the validity of such rights.
Modification of terms and conditions
These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to and the seller’s general terms and conditions of sale. In the event of a conflict, these Terms and Conditions shall prevail.
Applicable law
Belgian law is applicable. The courts of the Seller’s domicile shall have jurisdiction in the event of legal disputes.
